Terms
Terms of service
Version 2026-11-04.3 · Updated November 4, 2026
Illustrarium is developed and operated by Sergey Epifanov (the “Operator”, “I”, or “me”). These terms cover illustrarium.com and participation in the shared Illustrarium canvas through the iOS and Android apps and any web participation features made available. For questions or rights complaints, email [email protected].
Please be civil, treat other players with kindness, and help keep our shared canvas welcoming. If you see something hateful, abusive, or otherwise offensive, paint over it if you can. If you can’t, report it to the administrator through the in-app reporting controls or Support.
Before contributing: your artwork is public and other players can change it. When you expressly accept these terms and submit a contribution, you warrant that you have the necessary rights and grant me a broad licence to reuse it, including commercially, through third-party licences, and for AI training. You retain any copyright you hold. The rights and limits are set out below.
These terms take effect for you when you expressly accept them. Publication or browsing alone does not grant the contribution licence, and it does not apply retroactively to earlier contributions without a separate express agreement. On Android, you accept these terms and the community guidelines on the same welcome screen where you confirm that you are 18 or older. Acceptance is a separate choice from your age declaration. We record the accepted version and acceptance time against your player before shared-canvas contributions are permitted.
1. Access and your player
Participation is intended for adults aged 18 and older. You must meet that requirement and any additional requirements that apply in your country. An age declaration or platform age-range response does not itself constitute acceptance of these terms. The available sign-in and guest options depend on your platform and the access options presented in the app.
Keep your sign-in and recovery credentials private. Do not use another person’s player without permission, impersonate someone, or bypass access restrictions. Guest access, provider linking, and recovery depend on the version and features available to you. Losing an unlinked guest credential can mean losing access to that player. Contact Support for help.
2. A shared and changing canvas
Illustrarium is a public collaborative artwork. Other players can paint over your marks, and moderation, player deletion, and technical corrections can change the canvas. Buying paint or unlocking a color gives you no exclusive or permanent right to a location, no ownership of the whole canvas, and no guarantee that a mark will remain visible.
Follow the community guidelines. Do not engage in abusive or illegal behaviour or submit abusive or illegal Contributions. Do not contribute hateful, harassing, sexually explicit, exploitative, or otherwise prohibited material; disclose someone’s private information; infringe another person’s rights; disrupt the service; automate abusive activity; or exploit bugs to obtain paint or purchases improperly. Breaches can lead to suspension or a permanent ban and loss of access to progress and purchases, as explained in section 7.
3. Your contributions and your rights warranty
A “Contribution” is the imagery and other original visual expression you create and submit by painting on the Illustrarium canvas, including your original additions and alterations. It includes only rights you own or are authorised to license. Painting over, beside, or within another person’s work does not transfer that person’s rights to you.
You represent and warrant that you own or control the rights needed to submit your Contribution and grant the licence below, or have obtained the necessary permissions from the relevant rights holders. This includes permissions needed to reproduce or adapt existing imagery and to allow its licensed reuse. Your Contribution and its licensed reuse must not infringe copyright, trademarks, privacy, image rights, or other applicable rights. Being able to view an image elsewhere does not by itself give you permission to reproduce or license it here.
4. The licence you grant to Sergey Epifanov
Upon submitting each Contribution after accepting these terms, you grant Sergey Epifanov a non-exclusive, worldwide licence for the full duration of the applicable intellectual property rights, including extensions, to exercise each of the following rights, subject to the limits in these terms:
- Reproduction: copy, record, store, digitise, and reproduce the Contribution, in whole or in part, alone or together with other contributions.
- Public communication: display, exhibit, publish, perform, transmit, broadcast, and make the Contribution available to the public, including through on-demand access.
- Adaptation: crop, resize, recolour, edit, animate, arrange, combine, and otherwise adapt the Contribution, and reproduce, communicate, and distribute the resulting adaptations, subject to the protection of moral rights below.
- Distribution and commercial licensing: distribute, sell, and license copies and reproductions of the Contribution and its permitted adaptations, as part of the shared canvas or as separate images, collections, and products.
These rights may be exercised for operating and developing Illustrarium; displaying and preserving the canvas and its history; promotion and advertising of Illustrarium or other products and services; editorial, educational, artistic, entertainment, and research uses; and commercial exploitation through image licensing, publications, prints, merchandise, exhibitions, audiovisual productions, and digital products.
The permitted media and formats are websites, mobile and desktop applications, games, social media, digital image and video files, digital publications, printed publications, prints and posters, physical merchandise, exhibition displays, and audiovisual recordings and broadcasts.
Datasets and AI: the licence expressly includes incorporating Contributions into datasets and using them for text and data mining and for developing, training, testing, and evaluating machine-learning and artificial-intelligence models, for commercial or non-commercial purposes. It includes distributing and licensing those datasets and models to third parties, subject to applicable law and third-party rights.
I may authorise service providers, publishers, distributors, commercial partners, and other licensees to exercise these rights through sublicences within the same scope. I may transfer the licence with the Illustrarium business or the relevant artwork rights. These permissions apply to the specified uses and formats; they do not override legal requirements governing unforeseen forms of exploitation.
This licence is granted without a licence fee or royalties, including for commercial uses, except for remuneration or other rights that applicable law makes mandatory. You retain any rights you hold in your Contribution and may use or license it yourself. I am not required to use, publish, or commercialise any Contribution.
Subject to mandatory legal rights, the licence is irrevocable for its stated duration and survives your ceasing to use Illustrarium or deleting your player. Player deletion and personal-data handling remain governed by the Privacy Policy and applicable law. This licence does not authorise retention or reuse of personal data contrary to those requirements.
5. Changes, attribution, and moral rights
You authorise other participants to paint over, alter, combine with, or remove your visible marks through ordinary Illustrarium gameplay, and authorise my reproduction and display of the resulting canvas under the licence above. Contributions may appear in whole-canvas views, crops, archives, and recordings.
I may display your chosen public nickname where attribution is provided. Whole-canvas views, crops, and other reproductions may not identify every contributor separately. This does not waive any legally non-waivable right to attribution or respect for your work. Nothing in these terms transfers or extinguishes inalienable moral rights, permits a use prohibited by mandatory law, or represents that you endorse a product, service, or AI output.
You can grant only rights that you own or are authorised to license. Your warranty does not transfer another rights holder’s rights to me. This artwork licence is not consent to process personal data for unrelated purposes and grants no rights in your private account records or identity merely because you participate.
6. Paint, colors, and purchases
Paint is an in-game consumable, and paid colors unlock particular colors. These benefits have no cash-redemption value and are not financial assets. The game shows the applicable paint cost before an action; costs and available gameplay features can change. Purchases do not guarantee that the artwork they help create will remain visible.
A permanent color unlock means that the color does not require a recurring purchase while your player remains eligible to use it and the relevant feature and service remain available. It does not promise lifetime operation of Illustrarium or continued access after a permanent ban. Service closure or account restrictions can make unused paint, unlocked colors, and other purchased benefits inaccessible, subject to your mandatory consumer rights.
The applicable store or checkout displays the price and purchase conditions before payment. Apple handles App Store checkout on iOS and Google handles Google Play checkout on Android; I do not receive your payment-card details. RevenueCat supports transaction validation, entitlement delivery, and eligible restoration. The store displays the applicable localized price before you confirm payment. Pending, canceled, or failed purchases do not grant benefits before verification. Store terms and your mandatory consumer rights apply. Use the supported restoration controls for eligible purchases; already-consumed paint is not granted again through restoration. Refund and purchase help is available through Support, Apple, or Google Play. Eligibility depends on the applicable store rules, purchase circumstances, and law. Deleting a player does not itself request a refund, and restoration does not merge separate game wallets. Nothing here excludes a refund, remedy, or other right required by law.
7. Moderation and rights complaints
Abusive or illegal behaviour or Contributions, and other breaches of these terms or the community guidelines, are grounds for account restrictions, temporary suspension, or a permanent ban. Reports are reviewed, and disputed or prohibited content may be removed or restricted. Enforcement will take account of the nature and severity of the conduct and any repeated breaches. Serious or repeated breaches can result in a permanent ban; urgent action may be taken where necessary to address illegal activity, harm, or security risks, subject to applicable law.
During a suspension, you lose access to the restricted features and associated progress and purchased benefits for the duration of that restriction. A permanent ban ends your access to the shared service and can permanently deprive you of your player’s progress, paint balance, unlocked colors, and other purchased benefits. Those benefits are not guaranteed to transfer to another player, and creating another player to evade a restriction is prohibited. Subject to any refund, compensation, or other remedy required by applicable law or applicable store rules, I do not provide refunds or compensation solely because a valid restriction or ban prevents further use of those benefits.
Where required, I will provide reasons and information about available review. You can report content in the app or email the support address above with the relevant coordinates, a description of the concern, and, for a rights complaint, information explaining your rights or authority to act. Do not send passwords or unnecessary sensitive information.
Contact me if you believe a restriction or removal was mistaken. Review is not instant, and user-generated artwork is not guaranteed to be free of prohibited material.
8. Availability, privacy, and ending participation
Illustrarium is not a permanent service. It has no guaranteed operating lifetime and will eventually stop functioning. No closure date is currently announced. I may discontinue all or part of the service, subject to applicable law and any binding commitments. Features may also change, and maintenance, failures, moderation, and development work can interrupt the service or affect the canvas. I do not promise uninterrupted availability or permanent preservation of particular marks.
When the service closes, access to the shared canvas, your player, progress, unused paint, unlocked colors, and other purchased benefits may end permanently. Buying a benefit does not purchase perpetual hosting, storage, or access. For a planned closure, I will give reasonable advance notice where practicable and any notice required by law, and will handle outstanding purchases and any legally required refunds or other remedies in accordance with applicable law and applicable store rules. Urgent legal or security circumstances may require a shorter notice period. I remain responsible to the extent required by applicable law; these terms do not exclude liability or consumer remedies that cannot lawfully be excluded.
The Privacy Policy explains player data, service providers, retention, and privacy rights. You may stop participating at any time and request player deletion through the available in-app controls or the external deletion-request path, including after uninstalling the app. Deletion may change visible artwork through the rollback process described in that policy. Ending participation does not itself revoke a valid contribution licence, subject to mandatory legal rights and personal-data requirements.
9. Changes to these terms and applicable law
I will identify updates by their publication date and version. Material changes will be brought to participants’ attention before they are asked to accept them. An expanded contribution licence requires express acceptance and does not automatically extend to earlier Contributions. If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law.
These terms are governed by French law. If you are a consumer, this choice does not deprive you of mandatory protections or rights to bring proceedings that apply in your country of residence. Nothing here requires you to use an exclusive French court or waive mandatory consumer rights.
